EUROPEAN COMMISSION NOTE DATED FEBRUARY 14TH 2013 ON THE APPLICATION OF THE RULES OF NATIONALITY AND ORIGIN WITHIN THE ENPI CBC PROJECTS

According to the Note Beneficiaries and Partners of the ENPI CBC projects can, when executing public procurement, use national public procurement rules if two conditions are fulfilled simultaneously:


1.    These national rules do not restrict the conditions of nationality and origin as defined in article 21 of the Regulation (EC) No1638/2006 of the European Parliament and of the Council dated October 24th 2006 laying down general provisions establishing a European Neighbourhood and Partnership Instrument;

2.    The projects in question are co-financed by a public entity in an EU Member State.
The Beneficiaries and partners of the ENPI CBC projects, in which there is no public co-financing from an EU Member State, should apply the rules stated in article 21 of the Regulation (EC) No1638/2006.

As regards procurement conducted in Russian Federation, aforementioned exemption can be applied on condition that Russian public procurement rules equate with those used in European Union countries and project in question is co-financed by a public entity coming from an EU Member State.
